TERMS OF SERVICE

1. Acceptance of Terms
By engaging with CINEMAFLOW for the processing and production of materials and files, you acknowledge and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to any provision of these Terms, you must refrain from using our services.

2. Payment and Delivery Obligations
Clients are required to fulfill all payment obligations in full prior to the delivery of their packaged output files. CINEMAFLOW reserves the right to withhold delivery of the packaged output files until all outstanding balances have been settled.

3. Material Integrity
CINEMAFLOW provides a file conversion service and does not enhance, optimize, or otherwise improve the quality of the submitted content. The packaged output file is a direct conversion of the source material provided by the client.
All content submitted to CINEMAFLOW is subject to an internal screening process for quality assurance. If the source material fails the technical check and the packaged output files creation process cannot proceed, CINEMAFLOW will notify the client, who must resolve the issue before processing can continue.

4. Meeting Deadlines
In the event that technical issues with the source content delay the delivery of the packaged output files, the client assumes full responsibility for providing the necessary corrections. CINEMAFLOW is not liable for delays caused by the client's failure to supply corrected materials in a timely manner.

5. Limitations of Service
Once a packaged output file has been delivered, any subsequent updates, modifications, or changes requested by the client will incur additional charges.

6. Refund Policy
Refunds will only be granted in cases where the packaged output files fail to function properly due to errors in rendering. Refund eligibility is contingent upon CINEMAFLOW's verification process, which compares the reported issue against our validation system and provided validation report.

7. Confidentiality and Security of Materials
By using CINEMAFLOW’s services, you consent to the processing of your content through our rendering system for conversion. Your project will be hosted in our cloud infrastructure, utilizing Amazon Web Services (AWS). AWS employs industry-leading security measures, including end-to-end encryption, secure access controls, and continuous monitoring to protect against unauthorized access, data breaches, and cyber threats. Data is stored in compliance with stringent security standards to ensure the confidentiality and integrity of client materials.
The files you upload to our platform ("source files") will be stored on our system only for the duration of the service. Once the conversion process is completed, all source files will be permanently deleted. CINEMAFLOW does not retain archival or backup copies of the source files. However, the packaged output files created will be securely archived in our system for a period of one (1) year.

8. Limitation of Liability
CINEMAFLOW shall not be held liable for any damages resulting from the cancellation of screenings, festival applications, or any direct or indirect damages to servers, projectors, or venue infrastructure.
CINEMAFLOW guarantees that the delivered packaged output files comply with industry standards. However, if the projection environment does not meet these industry standards, CINEMAFLOW is not responsible for any playback issues that may arise.
